Car Insurance and Driving Offences

Offenses committed in connection with using a motor vehicle. Driving offenses may fall into two categories: those committed in failing to comply with regulations set out for the activity of driving; and those that are reprehensible acts committed in connection with the use of a vehicle. On conviction of one of the more stern motoring offenses, the details will be certified on the driver’s license.

The common regulatory offense is illegal parking. In principle, this is a criminal offense that goes with a fine, but it is scarcely ever regarded as such; it is, for example, routinely excluded from inquiries about criminal offenses made to people seeking employment. A similar offense is refusing to pay road tax, which may be taken more serious because it carries the hint of dishonesty.

Other regulatory offenses may be considered to be more serious because they suggest irresponsibility on the part of the driver, depending on the details of the offense. Driving an road cast vehicle may mean as little as having a broken indicator light, or as much as using a vehicle that is likely to go out of control. Similarly, driving without a ministry of Transport certificate of the vehicle's safety may have various implications. Driving without insurance is also an offense; in the event of an accident the uninsured driver may be unable to pay the compensation due to the victim.

The most serious offenses, however, concern the actual control of the vehicle, and the result of the driver's actions. In recent years the offense of driving under the influence of alcohol or illegal drugs has been taken increasingly seriously, as the number of accidents caused by drunken driving has become apparent. The difficulty of proving that a driver was appreciably affected by drink led in the 60s and 70s to the introduction of tests using breath-testing machines to determine the level of alcohol in the blood. An offense arises if the level exceeds a certain limit. In certain countries, it is an offense to drive with any amount of alcohol in the bloodstream. In the United Kingdom the limit allows a small amount of alcohol to be taken; on conviction, a driver must be disqualified unless the offense took place in exceptional circumstances, for example, if the driver was given “laced” drinks without his or her knowledge.

The standard offenses as to conduct in driving are careless driving and dangerous driving. The driver need not be shown to have driven carelessly or dangerously on purpose: if the driving was in fact careless or dangerous, the driver is guilty of the respective offense.

Where bad driving causes a death, the driver may be charged with manslaughter. Most times Juries, many of whose members were themselves drivers, showed a marked reluctance to convict on this charge, and it was supplemented by the offense of causing death by dangerous driving. It has been said that manslaughter should only be charged when the accused's conduct was so serious as more or less to amount to murder.
